This Privacy Policy explains how Bada Studios LLC, a Wyoming limited liability company doing business as BADA (“BADA,” “we,” “us,” or “our”), collects, uses, discloses, retains, and otherwise processes personal information when you use the BADA mobile application, website, livestreams, giveaway features, shopping features, communications, and related services (collectively, the “Service”).

BADA is a live shopping, entertainment, product discovery, and promotional giveaway platform. Users may watch livestreams, interact in chat, discover featured products, enter BADA-sponsored giveaways, purchase physical goods where available, and claim prizes if selected as potential winners.

By using the Service, you acknowledge that your personal information will be handled as described in this Privacy Policy.

1. Scope

This Privacy Policy applies to personal information we collect from or about users of the Service, including viewers, hosts, giveaway entrants, potential winners, prize winners, shoppers, users who contact us, and users who interact with BADA through our app, website, livestreams, support channels, or related services.

This Privacy Policy does not apply to third-party websites, platforms, services, payment processors, app stores, shipping providers, carriers, or other third parties that we do not control, except to the extent this Privacy Policy describes information we disclose to them.

2. Personal Information We Collect

We collect personal information directly from you, automatically from your device and use of the Service, and from service providers, app stores, hosts, brands, shipping partners, payment processors, and other users where relevant to the Service.

A. Account and Profile Information

We may collect:

- first name and last name, if provided;

- username;

- email address;

- password or authentication credentials handled through authentication systems;

- account creation date;

- account status;

- account settings and preferences;

- profile information you choose to provide; and

- profile photo or avatar, if the feature is available and you choose to upload one.

If BADA does not offer profile photos or avatars at the time you use the Service, we will not collect that information through that feature.

B. Age and Eligibility Information

Because BADA is intended for adults and because giveaways may have legal eligibility rules, we may collect:

- age confirmation;

- confirmation that you are at least 18 years old;

- confirmation that you are at least the age of majority in your jurisdiction;

- state of residence;

- city and state or other general location information;

- eligibility confirmations;

- account ownership confirmations;

- identity verification information where reasonably required for prize administration; and

- tax documentation where legally required for certain prizes.

BADA is not intended for children or minors. We use age and eligibility information to help determine whether users may access the Service, enter giveaways, claim prizes, and comply with applicable law.

C. Livestream, Chat, and User Content

We may collect:

- livestream video and audio you broadcast;

- chat messages;

- comments, reactions, likes, and other interactions;

- giveaway keywords or entry actions;

- content submitted in public or interactive areas;

- host activity;

- stream metadata;

- stream participation history;

- viewer counts and engagement metrics;

- bookmarked streams;

- moderation records;

- reports submitted by users; and

- enforcement records.

Livestreams, chat messages, usernames, entry actions, and other public interactions may be visible to hosts, brands, viewers, and other users.

D. Giveaway Entry and Prize Information

We may collect:

- giveaway entries;

- entry timestamps;

- entry method;

- selected winner records;

- claim status;

- eligibility records;

- prize records;

- winner notification history;

- prize acceptance or forfeiture records;

- affidavits, releases, or tax forms where required;

- fraud-prevention records; and

- giveaway audit records.

E. Shipping and Fulfillment Information

If you win a giveaway, are selected as a potential winner, claim a prize, or receive a shipment, we may collect:

- full name;

- shipping name;

- mailing address;

- street address;

- apartment, suite, or unit number;

- city;

- state or province;

- postal code;

- country;

- phone number if required by a carrier or fulfillment provider;

- shipping label information;

- carrier information;

- tracking number;

- shipment status;

- delivery confirmation;

- returned shipment records; and

- fulfillment support records.

F. Purchase and Transaction Information

If BADA offers shopping features and you make a purchase, we may collect:

- products viewed;

- products selected;

- order details;

- cart details;

- purchase history;

- price;

- taxes;

- shipping fees;

- discounts or promotional information;

- payment status;

- refund status;

- chargeback or dispute records;

- billing contact information;

- shipping information; and

- limited payment information provided by payment processors, such as transaction identifiers, payment method type, card brand, and last four digits.

BADA does not intend to store full payment card numbers. Payment information is processed by third-party payment processors.

G. Device, Technical, and Usage Information

We may collect:

- device type;

- device model;

- iOS version;

- app version;

- language settings;

- time zone;

- IP address;

- device identifiers or app instance identifiers;

- Firebase Cloud Messaging token;

- Apple Push Notification token or related notification identifiers;

- diagnostic data;

- crash logs;

- performance data;

- analytics events;

- screens, streams, or features viewed;

- stream viewing history;

- interaction data;

- approximate location inferred from IP address;

- fraud-prevention signals;

- app-integrity signals;

- device-integrity signals; and

- security logs.

H. Communications and Support Information

If you contact us, we may collect:

- your name;

- email address;

- username;

- message content;

- support history;

- attachments you provide;

- complaint details;

- dispute information; and

- communications preferences.

I. Brand, Host, and Partner Information

If you are a host, creator, brand representative, vendor, advertiser, prize provider, or partner, we may collect:

- business contact information;

- company name;

- role or title;

- product information;

- promotional materials;

- contract information;

- payment and invoice details;

- tax information where applicable;

- fulfillment information; and

- communications related to campaigns, products, and promotions.

3. Sensitive Personal Information

BADA does not intend to collect sensitive personal information except where reasonably necessary for limited purposes, such as:

- account login credentials;

- mailing address for shipping or prize fulfillment;

- payment-related information processed by payment processors;

- tax documentation where legally required for prize reporting;

- age or eligibility verification;

- fraud-prevention records;

- security records; and

- legal compliance records.

BADA does not intend to collect biometric identifiers, precise GPS location, health information, racial or ethnic origin, religious beliefs, union membership, or sexual orientation.

If BADA later collects additional sensitive personal information, we will update this Privacy Policy and provide any notice or consent required by applicable law.

4. Sources of Personal Information

We collect personal information from:

- you directly;

- your device;

- your use of the Service;

- other users, where their activity relates to you;

- hosts and livestream participants;

- brand partners and prize providers;

- service providers;

- payment processors;

- shipping and fulfillment providers;

- app stores;

- analytics providers;

- security providers; and

- publicly available sources where lawful and relevant.

5. How We Use Personal Information

We use personal information to:

- create, maintain, and secure accounts;

- authenticate users;

- provide livestream, chat, product discovery, giveaway, and shopping features;

- display usernames, chat messages, and livestream interactions;

- administer BADA-sponsored giveaways;

- record entries;

- select potential winners;

- verify eligibility;

- notify potential winners;

- process prize claims;

- generate shipping labels;

- ship prizes and products;

- provide tracking and fulfillment support;

- process purchases, payments, refunds, taxes, and chargebacks;

- send push notifications;

- send transactional and service communications;

- send marketing communications where permitted;

- personalize and improve the Service;

- analyze usage and performance;

- measure livestream and campaign performance;

- provide aggregated or deidentified reports to brand partners;

- detect, prevent, and investigate fraud, spam, abuse, bots, duplicate accounts, and platform manipulation;

- enforce our Terms of Service, Official Giveaway Rules, and community standards;

- moderate content;

- maintain safety and security;

- debug, repair, and improve the app;

- comply with legal obligations;

- respond to legal process and regulatory requests;

- resolve disputes;

- establish, exercise, or defend legal claims; and

- conduct business transactions such as mergers, acquisitions, financing, or asset sales.

6. Legal Bases Where Relevant

BADA is primarily a United States service. If a privacy law requires us to identify a legal basis for processing, we process personal information based on one or more of the following grounds:

- to provide the Service or perform a contract with you;

- to process transactions or prize claims;

- to comply with legal obligations;

- to protect the rights, safety, and security of BADA, users, and others;

- with your consent, where required;

- for legitimate business purposes, such as fraud prevention, analytics, support, app improvement, and platform integrity; and

- to establish, exercise, or defend legal claims.

7. Cookies, SDKs, Analytics, and Mobile Technologies

The Service may use cookies, software development kits, analytics tools, local storage, device identifiers, app instance identifiers, notification tokens, and similar technologies.

These technologies may help us:

- keep you signed in;

- authenticate your account;

- remember settings;

- deliver livestream features;

- send push notifications;

- measure app usage;

- detect crashes;

- understand feature performance;

- prevent fraud and abuse;

- protect app integrity; and

- support shipping, fulfillment, and customer service.

BADA uses or may use:

- Google Firebase, including Firebase Authentication, Cloud Firestore, Cloud Functions, Firebase Cloud Messaging, Firebase Analytics, and Firebase App Check;

- Agora.io for live audio and video streaming;

- Shippo for shipping labels and tracking;

- Apple Push Notification service and Apple device-integrity services;

- payment processors if purchases are enabled;

- customer support providers;

- hosting providers;

- analytics providers;

- security providers; and

- operational vendors.

If BADA later uses advertising SDKs, tracking SDKs, cross-app advertising identifiers, retargeting pixels, or similar advertising technologies, we will update this Privacy Policy and any required app store privacy disclosures.

8. Push Notifications

If you allow push notifications, we may send notifications about:

- bookmarked stream reminders;

- streams going live;

- giveaway start or ending reminders;

- potential winner notifications;

- prize claim reminders;

- shipment updates;

- account activity;

- safety or security notices; and

- Service updates.

You can manage push notifications through your iOS device settings.

9. Email and Marketing Communications

We may send transactional emails related to your account, giveaways, purchases, shipments, security, legal notices, and support.

If permitted by law, we may send marketing emails about BADA, livestreams, products, promotions, and campaigns. You may opt out of marketing emails by using the unsubscribe instructions in those emails or by contacting us at info@shopbada.com.

Even if you opt out of marketing emails, we may still send transactional or legally required communications.

10. SMS and Text Messages

BADA does not currently assume an SMS marketing program. If BADA later offers SMS or text-message communications, we will provide any consent, disclosure, and opt-out mechanisms required by applicable law before sending marketing text messages.

11. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients.

A. Service Providers

We disclose information to service providers that help us operate the Service, including providers of:

- hosting;

- databases;

- authentication;

- analytics;

- messaging;

- push notifications;

- livestreaming;

- cloud functions;

- fraud prevention;

- app integrity;

- payment processing;

- shipping labels;

- package tracking;

- customer support;

- moderation;

- security;

- tax reporting;

- legal compliance; and

- business operations.

B. Google Firebase

We use Google Firebase for authentication, backend infrastructure, database storage, cloud functions, messaging, analytics, and app-integrity support.

C. Agora.io

We use Agora.io to provide real-time live audio and video streaming. Agora may process livestream content and technical data necessary to deliver live streams.

D. Shippo, Carriers, and Shipping Providers

We may disclose winner or purchaser name, mailing address, shipment details, and tracking information to Shippo, carriers, and fulfillment providers to generate shipping labels, ship prizes or products, provide tracking, and resolve delivery issues.

E. Payment Processors

If purchases are enabled, payment processors may process payment information. BADA may receive transaction status, limited payment details, and related purchase records.

F. Apple and App Stores

We may disclose or receive information from Apple and app stores in connection with app distribution, push notifications, device integrity, crash reporting, analytics, account services, and platform compliance.

G. Hosts and Other Users

If you participate in public or interactive features, certain information may be visible to hosts and other users, including:

- username;

- public profile information;

- chat messages;

- livestream content;

- reactions;

- giveaway-entry actions shown in the stream;

- winner announcements; and

- other content you choose to submit publicly.

H. Brand, Advertising, and Marketing Partners

BADA may work with brands, manufacturers, retailers, vendors, creators, hosts, advertisers, and other marketing partners that pay BADA for advertising, product placement, promotional services, livestream features, prize funding, or prize supply.

BADA may share aggregated, deidentified, or campaign-level information with these partners, such as:

- entry volume;

- viewer counts;

- stream performance;

- engagement metrics;

- product interest;

- campaign performance;

- approximate fulfillment status; and

- non-identifying analytics.

BADA does not provide entrant email addresses, account information, or shipping addresses to brand or advertising partners for their own independent marketing unless you separately consent.

If a third-party prize provider is responsible for shipping, replacing, verifying, or supporting a prize, BADA may share the winner’s name, shipping address, contact information, prize information, and claim details with that provider solely as reasonably necessary for prize fulfillment, delivery, customer support, warranty support, fraud prevention, legal compliance, or dispute resolution.

I. Legal, Safety, and Compliance Recipients

We may disclose information if we believe disclosure is necessary or appropriate to:

- comply with law;

- respond to subpoenas, court orders, legal process, or government requests;

- protect rights, safety, property, or security;

- investigate fraud, abuse, or illegal activity;

- enforce our Terms of Service, Official Giveaway Rules, and policies;

- protect users, BADA, partners, or the public;

- preserve evidence;

- respond to disputes; and

- comply with tax, audit, or regulatory obligations.

J. Business Transactions

We may disclose or transfer information in connection with a merger, acquisition, financing, investment, reorganization, bankruptcy, sale of assets, or similar transaction.

12. No Sale, No Sharing for Cross-Context Behavioral Advertising, and No Targeted Advertising

Based on BADA’s current practices, BADA does not sell personal information for money.

BADA also does not currently share personal information for cross-context behavioral advertising or process personal information for targeted advertising as those terms are defined under applicable U.S. state privacy laws.

BADA does not provide entrant email addresses or shipping addresses to brands for their own independent marketing unless the user separately consents.

If BADA later adds advertising networks, retargeting pixels, cross-app tracking, data sharing for behavioral advertising, or brand lead-sharing, we will update this Privacy Policy and provide any notices, choices, or consent mechanisms required by applicable law.

13. Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Service, administer giveaways, fulfill prizes, process purchases, maintain records, prevent fraud, resolve disputes, comply with law, and enforce our agreements.

Retention periods vary based on the type of information and purpose.

In general:

- account information is retained while your account is active and for a reasonable period afterward;

- livestream, chat, entry, and interaction records may be retained after a stream ends for moderation, trust and safety, recordkeeping, giveaway administration, and dispute resolution;

- giveaway entries, winner records, eligibility records, prize claim records, shipping labels, and tracking numbers may be retained for legal, tax, audit, fraud-prevention, and fulfillment purposes;

- purchase and transaction records may be retained for accounting, tax, refund, chargeback, fraud-prevention, and legal purposes;

- security logs, app-integrity signals, device signals, and diagnostic records may be retained for security, anti-abuse, debugging, and platform-integrity purposes;

- support communications may be retained to resolve issues and maintain business records; and

- deidentified or aggregated information may be retained where permitted by law.

If you update or delete a saved shipping address, we may still retain historical shipping, prize, compliance, and fulfillment records relating to prizes or products already awarded, claimed, shipped, purchased, returned, disputed, or subject to legal retention.

When we no longer need personal information, we will take reasonable steps to delete, deidentify, aggregate, or otherwise dispose of it in accordance with applicable law.

14. Your Choices

You may be able to:

- update account information;

- update or delete saved shipping information;

- bookmark or un-bookmark streams;

- manage push notifications through device settings;

- unsubscribe from marketing emails;

- request account deletion;

- contact us to request access, correction, deletion, or a copy of personal information; and

- exercise privacy rights available under applicable law.

Some information may be retained as required or permitted by law, including for security, fraud prevention, legal compliance, dispute resolution, tax, accounting, prize fulfillment, purchase records, and enforcement.

15. Account Deletion

You may request deletion of your account through the app where available or by contacting us at info@shopbada.com.

After receiving a deletion request, we may need to verify your identity. We may retain certain information where required or permitted by law, including for security, fraud prevention, legal compliance, tax, accounting, dispute resolution, giveaway administration, prize fulfillment, purchase records, chargebacks, and enforcement.

16. U.S. State and Territory Privacy Rights

Depending on where you live and whether a particular law applies to BADA, you may have privacy rights under U.S. state or territory law.

These rights may include the right to:

- confirm whether we process your personal information;

- access personal information;

- obtain a copy of personal information;

- correct inaccurate personal information;

- delete certain personal information;

- opt out of sale of personal information;

- opt out of sharing for cross-context behavioral advertising;

- opt out of targeted advertising;

- opt out of certain profiling;

- limit certain uses of sensitive personal information;

- withdraw consent where processing is based on consent;

- appeal a denial of a privacy request; and

- not be discriminated against for exercising privacy rights.

BADA will honor legally required privacy rights where applicable.

We may verify your identity before processing a request. Verification may require matching information you provide with information we maintain. Authorized agents may submit requests where permitted by law, but we may require proof of authority and verification of identity.

17. California Notice at Collection

This section is intended to provide California-style notice at collection and related disclosures. It may also be useful to residents of other states with similar disclosure requirements.

A. Categories of Personal Information Collected

BADA may collect the following categories of personal information:

1. Identifiers, such as name, username, email address, account ID, device identifiers, app instance identifiers, notification tokens, IP address, shipping address, and transaction identifiers.

2. Customer records information, such as contact information, shipping information, and purchase records.

3. Protected classification information, such as age eligibility confirmation where required.

4. Commercial information, such as products viewed, products purchased, giveaway entries, prize records, purchase history, and transaction records.

5. Internet or electronic network activity information, such as app activity, stream viewing history, chat activity, usage data, device data, analytics events, and diagnostic data.

6. Audio, electronic, visual, or similar information, such as livestream video, audio, images, and chat-related content.

7. Geolocation information, such as approximate location inferred from IP address and user-provided city, state, or shipping address.

8. Inferences, such as engagement trends, product interest, and app usage patterns.

9. Sensitive personal information, such as account login credentials, precise mailing address, tax forms where required, and payment-related information processed by payment processors.

B. Purposes

We collect and use these categories for the purposes described in this Privacy Policy, including account management, livestreams, chat, giveaways, prize fulfillment, purchases, shipping, analytics, fraud prevention, security, legal compliance, and Service improvement.

C. Categories of Sources

Sources include you, your device, your use of the Service, service providers, payment processors, shipping providers, app stores, hosts, other users, brands, and business partners.

D. Categories of Recipients

Recipients include service providers, Firebase, Agora, Shippo, payment processors, Apple, shipping providers, hosts and other users for public features, brand partners for aggregated or fulfillment-limited purposes, legal recipients, and business-transaction recipients.

E. Sale and Sharing

BADA does not currently sell personal information or share personal information for cross-context behavioral advertising.

F. Retention

Retention is described in Section 13.

G. Sensitive Personal Information

BADA uses sensitive personal information only for purposes reasonably necessary to provide the Service, process transactions, fulfill prizes, secure accounts, prevent fraud, comply with law, and maintain records, or as otherwise permitted by law.

18. California Shine the Light

California residents may request information regarding certain disclosures of personal information to third parties for their own direct marketing purposes, if applicable. To submit a request, contact info@shopbada.com with the subject line “California Shine the Light Request.”

BADA does not currently disclose entrant email addresses or shipping addresses to brands for their own independent direct marketing without user consent.

19. Nevada Residents

Nevada residents may submit a verified request directing us not to make certain sales of covered information by emailing info@shopbada.com with the subject line “Nevada Privacy Request.”

BADA does not currently sell covered information as “sale” is defined under Nevada law.

20. Do Not Track and Preference Signals

Because there is not yet a uniform legal or technical standard for browser-based “Do Not Track” signals in the mobile-app context, BADA does not currently alter its practices in response to browser-based Do Not Track signals.

BADA does not currently sell personal information or share personal information for cross-context behavioral advertising. If BADA later engages in practices that require honoring opt-out preference signals under applicable law, BADA will update this Privacy Policy and implement required mechanisms.

21. Children’s Privacy and 18+ Eligibility

BADA is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

BADA is intended for users who are at least 18 years old and at least the age of majority in their jurisdiction.

If we learn that a child under 13 has provided personal information to us, we will take reasonable steps to delete that information. If you believe a child under 13 has provided personal information to BADA, contact info@shopbada.com.

If we learn that a user does not meet BADA’s age requirements, we may suspend or delete the account and restrict access to the Service.

22. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, destruction, loss, alteration, disclosure, or misuse.

No system, app, website, transmission, or storage method is completely secure. We cannot guarantee absolute security.

You are responsible for keeping your login credentials confidential and notifying us if you believe your account has been compromised.

23. Data Breach

If we discover a security incident involving personal information, we will evaluate the incident and provide notices where required by applicable law.

24. International Processing

BADA is intended primarily for users in the United States. We and our service providers may process and store information in the United States and other countries where we or our providers operate.

If you access the Service from outside the United States, you understand that your information may be processed in the United States, where privacy laws may differ from those in your location.

25. Third-Party Links and Services

The Service may link to or integrate third-party services. We are not responsible for the privacy practices of third parties that we do not control. Review their privacy policies before using their services.

26. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will update the Effective Date or Last Updated date and provide notice where required by law.

Your continued use of the Service after an updated Privacy Policy becomes effective means the updated Privacy Policy applies going forward.
