Official Giveaway Rules
Effective Date: April 17, 2026
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE, PAYMENT, ORDER, SUBSCRIPTION, DONATION, TIP, OR OTHER TRANSACTION WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.
These BADA Official Giveaway Rules (“Rules”) govern promotional giveaways conducted through the BADA mobile application, website, livestreams, and related services. Each giveaway is a chance-based promotional sweepstakes sponsored and administered by Bada Studios LLC d/b/a BADA.
Each individual giveaway may also include giveaway-specific details shown in the BADA app, livestream interface, website, giveaway screen, product page, or related notice, including the giveaway name, entry period, prize description, number of prizes, approximate retail value, entry method, entry limit, geographic eligibility, winner-selection timing, and claim deadline. Those giveaway-specific details are incorporated into these Rules.
If giveaway-specific details conflict with these Rules, the giveaway-specific details will control only for that specific giveaway, unless doing so would violate applicable law.
1. Sponsor and Administrator
Unless otherwise expressly stated in the applicable giveaway-specific details, each BADA giveaway is sponsored and administered by:

BADA is responsible for administering each giveaway, including the official rules, eligibility requirements, entry process, random winner selection, winner notification, prize claim process, and prize fulfillment process.
Third-party brands, manufacturers, retailers, vendors, creators, hosts, or other companies may provide products, prize funding, advertising support, promotional support, or other consideration to BADA in connection with a giveaway. Those third parties are marketing partners, prize providers, advertisers, or product collaborators only. They are not the sponsor or administrator of the giveaway unless the applicable giveaway-specific details expressly state otherwise.
Apple Inc. is not a sponsor of, does not endorse, does not administer, and is not involved in any BADA giveaway in any manner.
2. Eligibility
Unless otherwise stated in the applicable giveaway-specific details, each giveaway is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old and at least the age of majority in their jurisdiction of residence at the time of entry.
Void in Puerto Rico, Guam, the U.S. Virgin Islands, American Samoa, the Northern Mariana Islands, all other U.S. territories and possessions, overseas military installations, and wherever prohibited, restricted, taxed, or regulated by law, unless expressly stated otherwise in the applicable giveaway-specific details.
Employees, officers, directors, contractors, agents, representatives, and immediate family or household members of BADA, its affiliates, advertising and promotion agencies, prize providers, marketing partners, and other parties involved in the development or administration of a giveaway are not eligible to enter or win unless expressly permitted in the applicable giveaway-specific details.
BADA may exclude or restrict eligibility in any state, territory, or jurisdiction if BADA determines that legal, filing, bonding, registration, prize, shipping, tax, or operational requirements make the giveaway impractical or unlawful in that jurisdiction.
3. No Purchase Necessary
No purchase, payment, order, subscription, donation, tip, or other transaction is required to enter or win.
A purchase will not increase your chances of winning. A purchase will not affect eligibility, entry processing, winner selection, odds of winning, or prize claim rights.
Purchasing a product, buying from BADA, buying from a featured brand, bookmarking a stream, following a host, liking a stream, sharing a stream, subscribing to a service, or engaging with a shopping feature will not improve your chances of winning.
Any product-purchase feature in the BADA app is separate from giveaway entry. Products may be displayed, promoted, demonstrated, or offered for sale during a livestream or elsewhere in the app, but purchases do not affect eligibility, odds, winner selection, or prize claim rights.
4. Giveaway Details
Each giveaway may include additional giveaway-specific details shown in the BADA app, livestream, giveaway screen, website, product page, or related notice.
Those details may include:
- giveaway name;
- entry period;
- entry method;
- prize description;
- number of prizes;
- approximate retail value;
- geographic eligibility;
- age requirements;
- entry limits;
- winner-selection timing;
- claim deadline;
- shipping limitations;
- any free alternate method of entry, if applicable; and
- any other material terms.
The giveaway-specific details are part of these Rules.
5. Entry Period
Each giveaway begins and ends at the dates and times stated in the applicable giveaway-specific details.
Unless otherwise stated, all times are Eastern Time.
BADA’s servers, systems, and records are the official timekeeping method for all giveaways.
Entries received before or after the applicable entry period will not be counted.
6. How to Enter
The standard entry method will be described in the applicable giveaway-specific details.
Entry methods may include, for example:
- typing a designated keyword in livestream chat;
- tapping an entry button;
- sliding an entry control;
- completing another free in-app entry action identified by BADA; or
- using a free alternate method of entry provided by BADA.
All entries must be free.
If an in-app entry method is unavailable, technically interrupted, or determined by BADA to require a free alternate entry option, BADA may provide a free alternate method of entry. Any free alternate method of entry will receive equal treatment with the standard entry method.
Unless otherwise stated in the giveaway-specific details, there is a limit of one (1) entry per person per giveaway, regardless of entry method.
7. Entry Requirements
Entries must be submitted by an eligible natural person.
Entries must not be submitted by bots, scripts, automated tools, fake accounts, duplicate accounts, entry services, sweepstakes clubs, commercial entry services, device farms, or any other improper or manipulative means.
BADA may disqualify entries that are incomplete, late, duplicated, fraudulent, automated, generated by prohibited methods, associated with suspicious activity, or otherwise inconsistent with these Rules.
8. Winner Selection
Unless the applicable giveaway-specific details state another lawful random selection method, winners are selected at random by BADA from among all eligible entries received during the applicable giveaway period.
Giveaway animations, countdowns, visual effects, livestream graphics, or winner-reveal effects are for entertainment and presentation purposes only. The winner is selected by BADA’s random selection process and not by any animation that resembles a game of chance, wheel, slot, casino, or gambling device.
Odds of winning depend on the number of eligible entries received.
BADA may select alternate potential winners in case a potential winner is found ineligible, does not claim the prize in time, fails verification, refuses the prize, or otherwise forfeits the prize.
9. Winner Notification
Potential winners may be notified through one or more of the following methods:
- in-app notification;
- push notification;
- email;
- livestream announcement;
- direct message;
- account notification; or
- other contact information associated with the user’s BADA account.
A livestream announcement does not by itself guarantee prize award. Each potential winner must complete eligibility verification and claim steps before a prize is awarded.
10. Claim Deadline
Unless otherwise stated in the giveaway-specific details or required by law, a potential winner must respond and complete all required claim steps within seven (7) calendar days after BADA’s first attempted notification.
If a potential winner does not respond within the claim period, fails to provide required information, provides inaccurate information, cannot be verified, is found ineligible, violates these Rules, refuses the prize, or cannot accept the prize for any reason, the prize may be forfeited and BADA may select an alternate potential winner.
Need not be present, watching live, or actively online at the time of winner selection or notification to win, unless the applicable giveaway-specific details expressly and lawfully state otherwise.
11. Verification
BADA may require a potential winner to provide information reasonably necessary to verify eligibility, identity, age, residence, account ownership, shipping address, tax status, and compliance with these Rules.
BADA may require a potential winner to complete and return an affidavit or declaration of eligibility, liability release, publicity release, tax form, or other documentation where permitted or required by law.
Failure to complete verification may result in disqualification and prize forfeiture.
12. Prizes
Prize descriptions, quantities, and approximate retail values will be stated in the applicable giveaway-specific details.
Prizes may include physical goods promoted, featured, supplied, funded, or made available by BADA or by a third-party marketing partner, prize provider, manufacturer, retailer, or vendor.
Prizes are non-transferable, non-refundable, non-assignable, and may not be redeemed or exchanged for cash or credit unless BADA expressly states otherwise or cash substitution is required by law.
Any stated approximate retail value is BADA’s good-faith estimate. The actual retail value may vary. Any difference between stated approximate retail value and actual value will not be awarded.
13. Prize Substitution
BADA may substitute a prize with a prize of equal or greater approximate retail value if the advertised prize is unavailable, delayed, discontinued, out of stock, unsafe, recalled, restricted, misdescribed, impracticable to ship, unavailable from a prize provider, subject to a rights dispute, subject to manufacturer or distributor objection, or otherwise cannot reasonably or lawfully be awarded.
BADA may reject, remove, replace, cancel, or substitute any prize if BADA determines that the prize may be unavailable, unauthorized, counterfeit, infringing, recalled, unsafe, defective, unlawfully sourced, subject to shipping restrictions, subject to manufacturer or distributor restrictions, or otherwise unsuitable for a giveaway.
14. Featured Brands and Prize Providers
Third-party brands, manufacturers, retailers, vendors, creators, hosts, or other companies may compensate BADA, supply products, fund prizes, provide promotional materials, provide product information, or participate in livestream marketing.
Such third parties do not control winner selection, odds, eligibility, claim review, or prize administration unless expressly stated in the applicable giveaway-specific details.
BADA may describe a giveaway as “featuring” a brand, product, creator, or company. That language means the product or brand is part of the promotional content and does not mean the brand is the legal sponsor or administrator of the giveaway.
Brand compensation, product funding, advertising fees, or promotional payments do not affect giveaway eligibility, odds, winner selection, or prize claim rights.
15. Product Authenticity, Authorization, and Third-Party Product Issues
Unless expressly stated otherwise, BADA is not the manufacturer of third-party products awarded as prizes. Third-party products may be subject to the manufacturer’s own terms, warranties, limitations, safety notices, and support procedures.
To the fullest extent permitted by law, BADA disclaims all warranties regarding third-party products, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, condition, quality, and performance, except where such disclaimers are prohibited by law.
If a manufacturer, brand, vendor, or prize provider fails to deliver or authorize a product, BADA may provide a substitute prize of equal or greater approximate retail value, cancel the affected prize, or take another action permitted by law.
Nothing in these Rules limits any rights that cannot be waived under applicable law.
16. Shipping and Delivery
Physical prizes will be shipped only to eligible addresses within the fifty (50) United States or the District of Columbia unless BADA states otherwise.
Winners must provide a complete, accurate, and deliverable shipping address within the claim period. BADA may refuse to ship to P.O. boxes, freight forwarders, mail drops, hotels, temporary addresses, restricted addresses, incomplete addresses, or addresses outside the eligible territory.
Unless otherwise stated, BADA will pay standard shipping costs for physical prizes. Expedited shipping, special handling, customs, import duties, storage fees, reshipment fees, and other extraordinary charges are not included unless expressly stated.
To the fullest extent permitted by law, BADA is not responsible for delivery failure, delay, loss, theft, damage, destruction, misdelivery, return, or inability to deliver caused by:
- inaccurate or incomplete shipping information;
- winner failure to respond;
- winner failure to accept delivery;
- carrier delay or carrier error;
- weather;
- force majeure;
- restricted addresses;
- package theft after delivery;
- customs, regulatory, hazmat, safety, or export restrictions; or
- events outside BADA’s reasonable control.
If a prize is returned as undeliverable, refused, unclaimed, or otherwise cannot be delivered after reasonable effort, BADA may declare the prize forfeited and may select an alternate winner or otherwise dispose of the prize as permitted by law.
BADA may, but is not obligated to, replace a lost, stolen, damaged, or misdelivered prize after it has been tendered to the shipping carrier, except where required by law.
17. Taxes
Winners are responsible for all federal, state, local, and other taxes associated with prize acceptance, receipt, possession, or use.
BADA may require a completed IRS Form W-9 or other tax documentation before awarding a prize. BADA may issue an IRS Form 1099 or other tax form where required by law.
18. Publicity
Except where prohibited by law, by accepting a prize, a winner grants BADA and its designees the right to use the winner’s name, username, likeness, voice, city, state, prize information, and related content for advertising, promotional, winner-list, administrative, and publicity purposes in any media now known or later developed, worldwide, without additional compensation, permission, or notice.
19. Privacy
Personal information collected in connection with giveaways is subject to BADA’s Privacy Policy.
BADA may use entrant and winner information to administer giveaways, verify eligibility, notify potential winners, fulfill prizes, maintain records, prevent fraud, comply with law, and respond to legal or regulatory requests.
BADA may share winner information with shipping providers, prize fulfillment providers, and prize suppliers where reasonably necessary to fulfill a prize.
BADA does not provide entrant email addresses or shipping addresses to featured brands for their own independent marketing unless the user separately consents or unless disclosure is necessary for prize fulfillment and permitted by law.
20. Prohibited Conduct
Users may not:
- use bots, scripts, automation, fake accounts, duplicate accounts, device farms, or entry services;
- manipulate livestream chat, viewer counts, entry systems, rankings, engagement metrics, or winner selection;
- submit fraudulent entries;
- impersonate another person;
- provide false eligibility, identity, tax, account, or shipping information;
- harass, threaten, abuse, or interfere with other users, hosts, or BADA staff;
- attempt to hack, disrupt, reverse engineer, overload, or interfere with BADA systems;
- exploit bugs or technical errors;
- use the Service for illegal gambling, lotteries, raffles, or wagering;
- misrepresent brand relationships, product claims, endorsements, or sponsorships; or
- otherwise violate BADA’s Terms of Service, community standards, or applicable law.
BADA may disqualify any entrant, void entries, suspend accounts, cancel claims, withhold prizes, or take other action if BADA reasonably determines that the user violated these Rules or attempted to undermine the integrity of a giveaway.
21. Technical Issues
BADA is not responsible for lost, late, incomplete, inaccurate, delayed, misdirected, corrupted, inaccessible, or failed entries, notifications, messages, claims, or transmissions caused by technical failures, network issues, device issues, livestream interruptions, app outages, server issues, software errors, carrier issues, internet issues, or other events outside BADA’s reasonable control.
If a giveaway cannot be conducted as planned because of fraud, technical failure, unauthorized intervention, livestream disruption, security incident, force majeure, legal issue, or any other event affecting fairness, integrity, or proper administration, BADA may cancel, suspend, modify, or terminate the giveaway and may select winners from eligible, non-suspect entries received before the issue occurred.
22. Release and Limitation of Liability
By entering or accepting a prize, each entrant and winner agrees, to the fullest extent permitted by law, to release and hold harmless BADA, Apple Inc., prize providers, marketing partners, vendors, livestream hosts, service providers, advertising and promotion agencies, and each of their respective parents, affiliates, subsidiaries, officers, directors, employees, contractors, representatives, agents, successors, and assigns from and against any claims, losses, damages, liabilities, injuries, costs, or expenses arising out of or relating to:
- participation in a giveaway;
- entry or attempted entry;
- winner selection;
- winner notification;
- prize verification;
- prize acceptance, possession, use, misuse, delivery, non-delivery, or inability to use;
- technical failures or livestream interruptions;
- errors in giveaway materials;
- unauthorized human intervention; or
- fraud or misconduct by third parties.
To the fullest extent permitted by law, BADA is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from any giveaway or prize.
Nothing in these Rules limits rights or remedies that cannot be waived under applicable law.
23. Apple Disclaimer
Apple Inc. is not a sponsor of, does not endorse, does not administer, and is not involved in any BADA giveaway.
By participating in a giveaway, entrants release Apple Inc. from all liability related to the giveaway.
24. State Law Compliance
BADA intends to operate giveaways in compliance with applicable federal, state, and local law.
BADA may delay, modify, limit, cancel, or exclude any giveaway in any jurisdiction if BADA determines that registration, bonding, trust account, tax, shipping, age, disclosure, or other legal requirements make the giveaway impractical or unlawful.
For giveaways with prize pools that may trigger registration, bonding, trust account, or filing obligations in certain states, BADA may complete required filings before launch, lower the prize value, exclude affected states, or cancel the giveaway.
If a particular giveaway is not open in a given state or jurisdiction, the applicable giveaway-specific details will so state.
25. Winner List
To request the name of a winner for a specific giveaway, email info@shopbada.com with the subject line “Winner List Request” and identify the giveaway.
BADA may limit winner-list disclosures as permitted or required by law.
26. Governing Law
Except where prohibited by law, these Rules and each giveaway are governed by the laws of the State of New York, without regard to conflict-of-law principles.
Entrants may have non-waivable rights under the laws of their state of residence. Nothing in these Rules limits any non-waivable consumer rights.
27. Disputes
Any disputes relating to a giveaway are subject to the dispute-resolution provisions in BADA’s Terms of Service, including any arbitration agreement, class action waiver, governing law provision, and venue provision, except where prohibited by law.
28. Severability
If any provision of these Rules is found invalid, unlawful, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions will remain in full force and effect.
29. Changes to These Rules
BADA may update these Rules from time to time. The version in effect at the start of a giveaway will generally apply to that giveaway unless a change is required by law, necessary to protect giveaway integrity, or otherwise permitted by applicable law.
